ThisIndia CBN GuideregisterofImport sales contract of poppySeeds from Turkey were released on their official website on (25-06-2019). We've added our explanation for importers to understand it better.

  I.Determination of national caps

The national cap for the importation of poppy seeds from Turkey shall be approved by the Tax Agency on the recommendation of the Commissioner of Narcotics, a representative or a committee composed of the Directorate General of Foreign Trade (DGFT) and a representative of the Tax Agency. The national cap will be based on the stock and production of poppy seeds as communicated by the Turkish Grain Board (TMO) or the Turkish Embassy in India.

 Important note:The online system will be opened once after the government of India determines the national cap.

(a) Exporting companies in Turkey shall obtain sales contracts registered with TMO. After the sales contract is registered with the TMO, the Indian importer can submit an application for registration of the sales contract to the Narcotics Commissioner in the manner specified by the Narcotics Commissioner. The Commissioner of Narcotics may request the submission of original/certified copies of documents if necessary.

If the importer meets the following conditions, the anti-narcotics commissioner shall register the sales contract:

The importer shall apply for the registration of the import sales contract of poppy seeds in accordance with the format specified in the annex ",t", together with the following documents.

(b) Verify the authenticity of the importer's existence. The Narcotics Commissioner can perform such verifications based on documents submitted with the application. However, if the importer has not registered an import sales contract for poppy seeds in the last three fiscal years, the authenticity of the importer should be verified by physical verification.

(c) Each applicant shall be allowed to register the number of applications or 25 containers (450 metric tons), whichever is less. However, in a specific

Sales contract registration applications will not be accepted on or after the 15th^thIn July 2019, all such sales contract registrations are valid until the 31st for shipment from Turkey^stoneJuly 2019 only.

The Commissioner of Narcotics will only register sales contracts within the quantitative limits (national caps) for the specific crop year specified in paragraph 1 above.

Important note:TMO will register sales contracts in Turkey after

The government of India officially announced the national quota, not before. The Commission can also change each importer's 25 containers (450 tons) to 5 containers (90 tons).

Once the Narcotics Commissioner receives an application to register a sales contract for the importation of poppy seeds from Turkey, the Office of the Narcotics Commissioner will verify the fact of the registration of the sales contract with TMO (through the online system maintained by TMO).

ifThe sales contract isfound to beregistrantTMO, the Commissioner of Narcotics will grant provisional registration to the importer if the conditions set out in paragraph II are met. Such provisional registrations will be sent to the importer and the online system maintained by TMO will be updated accordingly.

The applicant importer, upon receipt of the provisional registration, will be required to open an irrevocable letter of credit (ILC) in favor of the Turkish exporter, paying in advance an amount not exceeding the total contract value. Registration in provisional registration is allowed.

Note: The contract value referred to in this clause will be pro-rated if the provisional registration allows for imports to be less than the quantity specified in the bundled sales contract.

 (A generation v)The applicant importer should re-contact Narcotics through their bank’s Narcotics Commissioner’s office within 10 working days of receipt of the Proof of Advance Payment/ILC Issuance and within 21 days of provisional registration being issued, together with the Proof of Advance Payment/ILC Issued The Commissioner shall issue to the importer a registration for the importation of poppy seeds from Turkey and update the online system accordingly. If the Office of the Narcotics Commissioner does not receive proof of such advance payment/opening of credit within 21 days from the date of the provisional registration, the provisional registration will be considered cancelled and the application will be considered rejected

(v) The applicant importer may choose to open the ILC/advance and submit the certificate to the Commissioner of Narcotics along with the application specified in subsection (Il)(a), in which case the registration of the sales contract will be issued to the applicant direct importer , the issuance phase without provisional registration

 Important note:A minimum advance payment of 20% of the contract value must be paid to register with TMO and proof of payment must be submitted to TMO to ensure the business is genuine. The exporter must prove that he has the goods in his warehouse in order to fulfill the contract on time.

Import applications for poppy seeds may be submitted under paragraph II (a) on or before 3 March in a given year, except for the current crop year 2018-19. Applications will not be accepted during the period1^stoneApril to 30^thJuneA specific year other than the current crop year 2018-19.

All sales contract registrations completed by the Office of the Narcotics Commissioner for a given crop year will expire on the 1st^stoneJuly. Therefore, the registration of sales contracts awarded by the Office of the Narcotics Commissioner for a particular crop year is valid until 30 June for that particular crop year.

Return the number of registrations

After the applicant has registered the sales contract, he or she may surrender part or all of the registered quantity in writing and received by the Commissioner of Narcotics within 30 days from the date of issuance of the registration.
